We think the Open Source Definition captures what the great majority of the software community originally meant, and still mean, by the term "Open Source". However, the term has become widely used and its meaning has lost some precision. The OSI Certified mark is OSI's way of certifying that the license under which the software is distributed conforms to the OSD; the generic term "Open Source" cannot provide that assurance, but we still encourage use of the term "Open Source" to mean conformance to the OSD. הקדמה

קוד פתוח לא אומר רק גישה לקוד המקור. תנאי ההפצה של תוכנת קוד-פתוח צריכים לענות על הקריטריונים הבאים:

1. הפצה חופשית

הרשיון לא יגביל אף צד מלמכור או למסור את התוכנה כרכיב בהפצת תערובת תוכנות המכילה תוכניות ממספר מקורות שונים. הרשיון לא ידרוש תמלוגים או תשלום אחר עבור כזו מכירה.

2. קוד המקור

התוכנית חייבת להכיל את קוד המקור שלה, וחייבת לאפשר הפצה בקוד המקור כמו גם בצורה מהודרת. כשצורה כלשהי של מוצר לא מופצת בקוד מקור, צריכות להיות דרכים מפורסמות-מספיק להשיג את קוד המקור עבור לא יותר ממחיר הפקה סביר - או עדיפה, הורדה דרך האינטרנט ללא חיוב. קוד המקור צריך להיות בצורה המועדפת בה המתכנת יוכל לערוך את התוכנה. קוד מקור מעורפל-במזיד הוא לא מורשה. צורות ביניים כגון פלט הקדם-מעבד או המתרגם לא מורשות.

הזכויות המצורפות לתוכנית חייבות להיות מיושמות על כל אדם שתופץ אליו התוכנית, ללא צורך בהפעלה של רשיון אחר מצדדים אלו.

8. רשיון לא מסוים למוצר

הזכויות המצורפות לתוכנית לא יהיו תלויות בכך שהתוכנית היא חלק מהפצת תוכנה מסוימת. אם התוכנית היא קטע מהפצה והשימוש או ההפצה שלה הם תחת תנאי רשיון התוכנית, כל הצדדים אליהם תופץ התוכנית יקבלו את אותן הזכויות שהוענקו יחד עם הפצת התוכנה המקורית.

Origins: Bruce Perens wrote the first draft of this document as "The Debian Free Software Guidelines", and refined it using the comments of the Debian developers in a month-long e-mail conference in June, 1997. He removed the Debian-specific references from the document to create the "Open Source Definition."
